Invited by the New York State Bar Association’s Advanced Real Estate Topics among an esteemed panel of practitioners, Adam Leitman Bailey used his experiences as a commercial leasing litigator to discuss in his presentation how transactional attorneys can improve their lease writing skills. Some of the issues discussed included liquidated damages, using a license versus a lease, provisions for property owners including chronic non-payment, acceleration clauses, self help evictions, Yellowstone injunctions, and for commercial tenants, mitigation of damages, prevailing party clauses in commercial leases, right of expansion clause, options to renew, and limiting the good guy guarantee.
