Adam Leitman Bailey Presents at New York State Bar Association Advanced Real Estate Topics: “Advice from a Litigator”
Invited by the New York State Bar Association’s Advanced Real Estate Topics among an esteemed panel of practitioners, Adam Leitman Bailey used his experiences as a commercial leasing litigator to discuss in his presentation how transactional attorneys can improve their lease writing skills. Presenting his tricks of the trade and applying practical experience, Mr. Leitman Bailey delved into some of most sophisticated and controversial lease provisions and provided sample ways to improve default clauses, motivate tenants to comply with their lease, and allow tenants to have a fair lease. Some of the issues discussed included liquidated damages, using a license versus a lease, provisions for property owners including chronic non-payment, acceleration clauses, self help evictions, Yellowstone injunctions, and for commercial tenants, mitigation of damages, prevailing party clauses in commercial leases, right of expansion clause, options to renew, and limiting the good guy guarantee.
