Introduction
My name is Massimo D’Angelo, and I am a partner in the litigation department at Adam Leitman Bailey PC. I’ve been working here for approximately five years. One of my biggest accomplishments was a case I settled recently involving a water tower in a Chinatown building. Our client had purchased a building that had a long-term lease with a tenant running a famous Chinese ice cream factory on the ground floor. The seller had entered into a sweetheart lease agreement with the tenant, who was paying very low rent. Our client was aware of this before purchasing the building but found that there were massive water bills—ranging from $3,000 to $4,000 per month. After researching, we found an archaic New York law that had never been used before. The law stated that a tenant cannot waste or maliciously misuse water, and we used it to file for an injunction, requesting a joint inspection of the water tower serving the ice cream factory. We discovered the water tower was leaking massively, which explained the excessive water bills. Thanks to this law, we were able to settle the case to our client’s benefit, which was a great accomplishment. The client was very satisfied, and you can see their testimonials on our website.
