My name is Stephen Weiss, and I’ve been in the mortgage and real estate business for about 28 years—so I’m not a newbie in this field. I’ve probably dealt with over a hundred real estate attorneys, and I get along with most of them. However, Adam Leitman Bailey stands out for a very good reason, and I want to tell you why.
The following gesture not only shows his strength as an attorney but also his character.
A few years ago, I signed a contract of sale to purchase a new development condominium on the Lower East Side. After the contract was fully executed, I started to think that this location and price might not be the best choice for me and my wife. The purchase was strictly for investment purposes, and I already own several other condominium units in Manhattan.
Most new development contracts are not contingent on a mortgage, but the developer in this case had their own bank. If you go through their bank, the contract becomes contingent on financing. Being in the mortgage business, I prefer to go through my own bank.
Anyway, there was a paragraph missing in that contract of sale that Adam specifically found in a matter of two minutes. He calmly pointed it out and said, “There’s a paragraph missing. Let’s get them on the telephone.”
Adam picked up the phone as I sat right next to him in his office and contacted the developer’s counsel. They wanted to call Adam back, but he refused. He kept saying, “I’ll hold.”
They eventually got back on the phone 15 minutes later, but Adam stayed persistent. Finally, after about an hour and 10 minutes, they picked up the phone again. Adam said, “Listen, there’s no case here. If you want to be on the *New York Post* and everywhere else, you can continue this. Otherwise, you should do the right thing.”
They relented and said they would send my money back, which was a lot of money.
Adam is very smart, very aggressive, and incredibly honest. He knows his stuff.
The most important thing about this experience? He didn’t charge me one penny for the two hours he spent with me on the phone and during the pre-conference. I offered to pay, but he refused.
The only way I could ever repay him is by referring clients to him. This gesture was so kind, and it will never be forgotten.
