Panel Synopses: Real Estate Panel

Solving the explosion in Real Estate related litigation through Alternative Dispute Resolution – especially Mediation – will be discussed, with a primary focus on Foreclosure actions and litigation related to Condominium and Cooperative interests in realty. The panel will explore the benefits and drawbacks of Arbitration and Mediation in resolving these disputes. Is Mediation a panacea, or ultimately, simply a delaying tactic to provide the homeowner with more time to deal with his/her financial shortcomings? We will explore the New York Attorney General’s power to force parties involved in disputes over Condominium and Cooperative interests in realty to resolve the underlying dispute through Arbitration or Mediation: can the New York Attorney General require developers to include a clause in their contractual agreements mandating that all future disputes be resolved through either Arbitration or Mediation? — Taken from the Symposium’s brochure
